Lehman Chief Denounces ‘Flat-out Silly’ Claims

Creditors of Lehman Brothers have filed claims for the return of $824 billion and total claims may reach $1 trillion, the chief executive of the investment bank said.
Bryan Marsal, a restructuring expert who was installed as chief executive to run Lehman in administration, told a hearing in New York that some creditors’ claims were just flat-out silly.
Mr. Marsal said that the bank probably would call on a US bankruptcy judge to decide on claims that Lehman believes are overstated. Without mentioning names, Mr. Marsal told the court hearing that Lehman’s biggest and most sophisticated creditors were among those making inflated claims. Lehman’s largest creditors include JP Morgan, Deutsche Bank and Fannie Mae. Lehman Brothers International, the European division of the bank, is its largest creditor, with administrators claiming about $200 billion from the American parent.
Mr. Marsal said that Lehman aimed to have evaluated all claims by the end of the month and that it held $16 billion in cash.

Top Job at Wm Morrison Wide Open as Bolland Heads for M&S

The race is on to replace Marc Bolland, who is leaving Wm Morison to take Sir Stuart Rose’s place as chief executive of Marks & Spencer. A host of British retail’s leading lights, and some candidates from outside the sector, were mentioned in connection with the post.
Sir Ian Gibson, the chairman of Morrisons and the chairman of its nominations committee, is understood to be eager to bring the selection process to a close as quickly as possible. The upermarket has not appointed a headhunter but is likely to do so soon. Egon Zehnder, one of the world’s biggest executive search companies, recruited Mr Bolland from Heineken, the Dutch brewer, in 2006.
Shares in Morrisons lost 14.6p, or 4.9%, to 280.9p after the announcement of Mr Bolland’s departure. He will leave on January 31.

Employers can bring disciplinary action against an employee if there is a clear policy on blogging and that policy is breached. However, what your staff may write under a cloak of anonymity outside of the working day may also be PR for your firm, just the wrong kind.
While it is hard to make a clear legal demarcation between employees’s private and office lives, reputational damage may arise from written content posted by employees.
Employers run little risk of incurring liability for their employees’ blog as, unless a person’s personal blog can be linked to their work, the employer is unlikely to face a defamation, breach of confidence or intellectual infringement claim by affected persons.
One could, however, claim that the employee’s blog has brought the employer into disrepute. In 2004, bookstore Waterstone’s sacked an employee for his disgruntled blogging, the first UK case of its kind. Recently, Asda dismissed an employee for complaining about their job on a blog, and a Swiss insurance firm gave a worker the sack after she was caught surfing through Facebook while she was meant to be so ill that she could not use a computer.
And don’t think anonymity will protect you: the recent Times vs Horton Night Jack case may have blown that protection. The case, where The Times revealed the identity of the prize-winning Night Jack blogger, turned on balancing an individual’s right to privacy and freedom of speech. The Times revealed that author Richard Horton was a PC for the Lancashire Constabulary. The judge, Justice Eade, questioned whether he had a right to privacy, given that his blogging was essentially a public activity. The court found that there was a countervailing public interest in revealing that a PC had been writing the blog.
This case will not necessarily set a precedent but it indicates that people should be careful of what they write. It is not the same as having a moan in the pub.

The credit crunch has handed the government the means to create a British Banking Corporation. UKFI should consider buying out the minorities of RBS with the proceeds of the sale of its minority stake in Lloyds, and then inject Northern Rock into RBS.
The bank would need to be owned by a trust modelled on the BBC’s, with a long-term charter to offer high-quality, affordable banking services to the retail and wholesale sectors. The charter would require it to remain independent of government interference and to operate on commercial principles, with a targeted return on capital that is debated and agreed by Parliament, with reviews every ten years. Any profits above the targeted rate of return could be used to fund a long-term development bank for infrastructure projects such as high-speed rail. The prospect of a stable banking industry, with profits held in check by the presence of one large, not-for-profit player, would make the recent bail-outs seem a price worth paying.
